PKY1 Incorrect Dividend for UK Tax Payer

Hello, I received a dividend payment on 25 June 2026 (ex-date 17 June 2026) from PKY1 in my ISA account. The withholding tax applied was 19%, however I should’ve been charged only a 10% as per my understanding of the UK-Polish Dual Tax Agreement Double Tax Treaty.

Is there any way to claim back the 9% difference? Support was not helpful at all. I hold a considerable amount of that stock now and the 9% difference is a lot of money for me.

I can’t offer any advice on this but found this page which might be helpful - Poland Dividend Withholding Tax for United Kingdom Investors (2026) | Tax Reclaim (read the whole thing as there’s some comments on ISA’s that might be relevant). Frankly, it sounds like a headache…

The source is incorrect . Withholding tax is 10% not 15% as per DT15402 - Double Taxation Relief Manual: Poland: treaty summary - HMRC internal manual - GOV.UK . There is no mention of 15% anywhere in the treaty or treaty summary.

Quick google says that “PIT-ZG is an annex used by Polish tax residents to report income earned outside of Poland”. As I’m not a Polish tax resident, I can’t use this.

If the link cant get these two basic things correct, I have no reason to believe the rest of the information there is correct.
