@askkarlos. Understood . But in an ISA or Invest account ?
Sounds a dumb question but it makes a difference

@Finki it is in both accounts

How does it make a difference ?

I’d need to check over the regulations but I think T212 might be in breach of ISA rules if any ISA held asset isn’t tradeable within X period of time/days. Which a 1/2 month delay breaches.

Plus… big one… OTC stocks are not allowable in ISAs. So they should have known they were moving to OTC, Messaged all holders and shifted all positions to Invest accounts. As it stands they would be in breach of ISA rules if not moved ASAP.

Probably worth T212 acknowledging (or refuting) this and communicating what they intend to do

(Brokerage Ops inefficiency drives me crazy and makes my OCD flare up!!!)

Exactly, they keep holding my stocks as well while I requested to sell them 3 weeks ago. I have recently sent an email to the FCA to get assistance and speed up the process, I don’t understand why T212 is not just taking care of this singular case as some other traders do and help us to sell the shares OTC this time only.

I will also draft a letter to the FCA. We need this issue dealt with ASAP

I think our communication could have been better here, so apologies.

Regarding ISA holdings - yes, anything that trades OTC is not on a designated exchange so is not ISA admissible. The ISA rules say in cases like this, within 30 days of delisting, the stock must be sold or moved out of an ISA (which I take to mean sold and repurchased to avoid screwing up tax liabilities). The stock was delisted around 10th June - the exact date escapes me. Either way, we have been working to find an acceptable solution. Clearly we don’t want to move stock that you then cannot sell.

What is the issue with selling the stock OTC

Getting a reliable price feed.

It sounds ridiculous, but we have had false starts and dead ends in sourcing a reliable price feed for an OTC market. This still is not fixed. Judging from the comments on here, many of you know roughly where the stock is, so the dealing team have agreed that the best temporary fix is to enable trading on the stock without a price feed - you can set a limit order. It’s ugly, but better than delaying further. We aim to have this in place on Monday.

As we get towards the 30-day from delisting, we will contact ISA holders who can sell the stock. Any ISA holdings remaining we will have to sell forcibly.

Hi Nick,

Thank you very much for your reply, at least we can see the efforts you and Trading212 team is making in trying to solve this case for us, thank you again and hopefully as you said by Monday we will see a positive change. I didn’t actually understand what is an ISA, I am new to investing however my shares are on the Invest part of T212. I don’t really want to trade any further the stock Latam Airlines it has been annoying me enough seeing it among my instruments since almost a month now so my wish and hope is to sell it ASAP, with your kind help. Thank you again and looking forward to good news.

Hi Nick,

I have noticed since yesterday that the system suspended the Latam instrument and doesn’t give me the chance to give the selling order as per below (Invest):

I believe that by the time the market opens I will be able to proceed?

Thank you.

The dealing team want to do some final tests once the market opens, but hope it will be in place shortly after opening.

Thank you. Its been a stressful ordeal. Atleast we dont have to go down the road of fighting a case to recover our money.

I finally was able to sell the Latam shares… at a very cheap price though… the OTC price I guess, but better than losing the whole investment, I believe that Latam won’t end up nicely considering the down path they are following. Thank you Nick and Team T212 for fixing this issue somehow.

I STILL CANNOT SELL this INSTRUMENT

@askkarlos

Have you tried setting limit order as advised?

Yes nothing works

I see stop limit sell, maybe that is the reason for failed? maybe try only limit sell?

Did your sell order go through or stay pending ?
