To my understanding this is standard, US witholding tax agreement between US&UK is 15%.

Now if you can get tax credit in UK for tax paid in US that is other topic. But 15% witholding is standard for UK investors in investing/ISA account…

Thank you. I just received the dividend from WFC and yes, it was 30% less than the declared, so i t makes sense for 30%. Does this rate applies to EU stocks, also? I think I read somewhere that for FR stocks for non-FR investors the the witheheld tax is appr. 12%.

Wouldn’t it be great to have a page dedicated for each countr to have info about the withheld dividend tax?

One more question - Will we get taxed a higher percentage on dividends for REITS? Specifically ‘Realty Income’, due to the ‘unqualified’ dividend classification. Also, will this matter if in the ISA account?

dividends for REITs depend on the company itself, a good example to look at is British Land (BLND) or a mix of both. every dividend is paid as either normal dividends or PID (Property income distribution) and the PID gets counted against your income tax rather than your dividend tax. occasionally they offer more normal shares in place of a cash dividend.

In an ISA neither the PID or dividends will mean taxes for you to pay, its only an issue when held in the Invest account. which is why holding a UK REIT in an ISA can be the biggest tax-break option for your money (performance may not mean its the most lucrative however).

Realty Income, being a US REIT means UK investors, having filled out the W8-BEN form dividends will face a 15% tax before they are paid out. These dividends in an ISA will not face further taxes, but those held in the Invest account would face normal dividend tax rates according to UK tax laws.

if you are new then it should have been handled during your account activation and verification. otherwise you will see a message when you acquire US stocks on the web-platform that will use account details to fill one out for you.

This is confusing regarding that USA withholding tax deduction on dividends for USA non residents is usually 15%. Is it possible that we do not have to pay any taxes in USA on dividends from USA MLP and that all tax on dividends we have to report and pay only in our country of living?

Hey David, sorry to bump you on a old threat but I wanted to ask if the tax treaty for US and Italy works for every US company we can buy shares of. Or is there any exception?

According to what I read, “quarterly distributions from the MLP are treated as a return of capital (ROC), as opposed to dividend income. So, the unit-holder does not pay income tax on the returns.”

My guess is that for UK taxpayers it might be that the income you receive is to be taxed as income at your marginal income tax rate, not at capital gains or dividend tax rates. There is a special place in the Foreign section of the self-assessment return to put income like this. Another thing that goes in that place is income from HMRC non-reporting US mutual funds. I am guessing that MLPs are similar.

I had the same situation with HEP (Holly Energy Partners MLP). Got gross dividends.

This article gives some good explanation but I’m still not sure what I will do when I have to file my tax report next year.

Thank you for respond. I can not believe that no one knows how deducted withholding tax on dividends or as you sad return of capital (ROC) from USA MLP is done for non USA residents. I have bought couple of stock from Enterprise Product Partners EPD. In the moment of buying I even did not know that EPD is MLP and that they do not pay dividends but ROC although on nasdaq it stands as dividend payment. However I have got as many others from the same or other MLP full amount of dividend or ROC. I was expecting that there will be automatically maximum deduction or at least 15% according to W8-BEN, but there was no withholding tax deduction from USA tax authorities. So I am confused about that issue, because all withholding taxes on dividends if they are deducted are automatically deducted before paying on a shareholder account.

I am not from England but from Slovenia and as Slovenian resident I have to report any capital incomes from dividends or stocks only to the authorities in my country of living. Incomes from dividends or stock are here taxed as capital gains and are separated from other incomes as salary and so on. However I do not see any reason to report any capital incomes to USA authorities as non USA resident. Actually I have got answer that all capital incomes from USA stocks or dividends as non USA resident I have to report only in my country of living and that withholding tax on dividends is 15% for USA based companies. But when I have asked is it the same situation with dividends or incomes from MLP companies no one gave me any answer about that issue.

It would be very helpful if someone can explain how is going on about taxation on dividends or incomes from MLPs, because if USA withholding tax deduction on incomes from MLPs are for USA non residents 0% than those stock are excellent to buy because they have high value of dividends or (ROC).

So as I understand we have to report and pay taxes on incomes from stock and dividends only to tax authorities in our country of living.

That is for Canadian residents. I can understand also that they have deducted 39.6-per-cent withholding tax to us that are residents in other countries but I do not understand how it is possible that there was no withholding tax. Because of all so different information on that issue it would be grate that those who have had experience about this explain it. I really do not see any reason to report any capital incomes to USA authorities as non USA resident.

Can you please check if my W-8BEN is filled too ? I think I am taxed too much , I got less than half of AGNC’s monthly div!

I can confirm that for Romanian tax residents the tax is 10% in other platforms.

However, I think it is automatically filled in when you sign up.

Even if they classify as something different to dividends, does anyone know if UK investors would be exempt from paying any UK tax for it if they invest in MLPs through an ISA? (Similar to dividends and capital gains)

Nothing in an ISA is ever taxable by HMRC.
